RESIDENTIAL PROPERTY RIGHTS IN VIETNAM

 

 

Article 159. Owning housing and housing ownership forms for organization and foreign individuals in Vietnam.

 

  1. The organizations and foreign individuals to own houses in Vietnam included:

 

  1. Organizations and individuals investing in the construction of the project in Vietnam under the provisions of this Act and related legislation.
  2. Foreign enterprises with the investment, branch offices and representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam (hereinafter referred to as foreign organizations)
  3. Those foreign individuals are legally allowed to enter Vietnam.

 

 

  1. Organizations and foreign individuals to own houses in Vietnam through the following forms:
  1. Investmenting in housing construction project in Vietnam under the provisions of this Act and related legislation.
  2. Purchase, lease, donation, inheritance commercial housing including apartments and individual houses in investment projects in building, except for the area to ensure defense and security as prescribed by Government.

 

 

Article 160. Conditions - organizations and individuals to own houses in Vietnam.

  1. For organizations and individuals specified in paragraph 1 of Article 159 of this Law shall have the certificate of investment and housing construction project in accordance with the provisions of this Act and related legislation.
  2. For foreign entities specified in paragraph 1 of Article 159 of this law, there must be investment certificates or documents relating to the permitted activities in Vietnam (hereinafter referred to as the original Certificate investment issued by the competent state of Vietnam)
  3. For individuals specified in paragraph 1 of Article 159 of this Law shall be allowed to enter Vietnam and not entitled to the privileges and immunities of diplomatic, consular prescribed by law.
  4. Government regulations detailed proof of the object, condition of organizations, individuals are entitled to own houses in Vietnam.

 

 

Article 161. The rights of homeownership to the organization and individuals.

  1. Organizations and individuals specified in paragraph 1 of Article 159 of this Law is to exercise the rights of homeownership in accordance with the provisions of Article 10 of this Law; case building on leased land, only the right to lease housing.
  2. Organizations and individuals specified in points b and c, Clause 1 of Article 159 of this Law shall have the rights of homeowners in Vietnam but as citizens must comply with the following provisions.
  1. Only to buy, lease, donation, inheritance and ownership does not exceed 30 % of the apartments in an apartment building; if the individual houses including villas, houses adjoining it on an area with a population equivalent of a ward-level administrative units only buy, lease, donation, inheritance and facilities possession of 250 homes.
  2. Where are donated or inheritance is not subject to the provisions of Point b, Clause 2 of Article 159 of this Law or exceed the amount specified in this clause shall only be entitled to the value of such housing.
  3. For foreign individuals, it is owned housing as agreed in the contract of sale transactions, purchase contract, donation or inheritance in but not exceeding 50 years from the date of issuance of certificate and can be extended under the provisions of the Government if required; housing ownership period must be specified in the certificate.
  4. For foreign entities to own the house as agreed in the contract of sale transactions, purchase contract, donation or inheritance but not exceeding the time limit stated in the certificate of investment for the organization, including extended time; housing ownership period is calculated from the date of the certificate and be clearly stated in.

 

 

Article 162. Obligations of the homeowners – for organizations and individuals.

  1. Organizations and individuals specified in paragraph 1 of Article 159 of this Law shall have the obligations of home owners in accordance with the provisions of Article 11 of this Law.
  2. Organizations and individuals specified in points b and c, Clause 1 of Article 159 of this Law shall have the obligations of homeowners in Vietnam but as citizens must comply with the following provisions.
  1. For foreign individuals owners are allow to rent out the house to use for rental purposes not prohibited by law, but prior to renting out the housing, the owner must provide written notice of the rent with regulatory authorities in the local district where the house under the guidance of the Ministry of Construction and the tax payable from the leasing of housing in accordance with the law.
  2. For owners of the foreign organizations are only used to arrange housing for people working in the organization in, not be used for rental housing, office or on other purpose.
  3. Make payment for the purchase, lease-purchase housing through credit institutions operating in Vietnam.
